Before purchasing court fee

Check whether fee relief or free legal services may apply

The calculator shows the ordinary statutory fee. It does not subtract a waiver or decide eligibility. The following routes require a separate application and a decision by the court or legal services authority.

Civil suits · Order XXXIII CPC

A person without sufficient means to pay the prescribed plaint fee may apply for permission to sue as an indigent person. The court examines the person's means and can allow, refuse or later withdraw that permission.

Read Order XXXIII on India Code

Civil appeals · Order XLIV CPC

A person unable to pay the fee on a memorandum of appeal may apply to appeal as an indigent person. The appellate court decides the application; the calculator result should not be reduced in advance.

Free legal services in Tamil Nadu

TNSLSA lists category-based eligibility under section 12 and an annual-income ceiling of ₹3,00,000 for cases before courts other than the Supreme Court. NALSA states that approved legal aid may include required court fees and incidental expenses.

Practical next step

Check eligibility before buying e-court-fee. An Order XXXIII application must include the plaint particulars and a verified schedule of the applicant's movable and immovable property. For legal aid, contact TNSLSA, the High Court Legal Services Committee, or the relevant District or Taluk Legal Services Committee.

Fee relief is not automatic. The applicable procedure, evidence, timing and final liability for court fees depend on the court's order and the outcome of the proceeding. Seek case-specific advice before filing.

Source and coverage

The calculator implements the principal civil valuation rules, fixed Schedule II filings, MACT petitions and appeals, probate stages, insolvency and trust applications, civil and criminal appeals, bail filings, revisions, arbitration entries, cheque-bounce complaints, the 2017 revised fee structure and the 2024 Madras High Court Intellectual Property Division fees. It does not infer the legal character of a prayer. You select the applicable statutory entry.

Common questions

Does the Madurai Bench use a different court-fee schedule?

No. The Madurai Bench is part of the Madras High Court and uses the same Tamil Nadu statutory fee schedule. The calculator keeps the bench separate so it can show only filing categories ordinarily available there.

What is the current Tamil Nadu ad valorem court-fee rate?

Schedule I, Article 1 was substituted by Tamil Nadu Act 6 of 2017. The current rate is 3% of the amount or value in dispute, with any fraction of a rupee rounded up under section 21-A.

Does the estimate include every amount paid at filing?

No. It calculates the selected court-fee entry. Multiple reliefs, process fees, welfare stamps, copying charges and other filing amounts may be additional.

How current is this calculator?

The court-fee Act was checked through Tamil Nadu Act 43 of 2024. The MACT schedule, current section 173 appeal threshold and official fee-relief sources were rechecked on 20 August 2026. The source date is displayed on the page and should be rechecked whenever the Act or Rules are amended.

Can a person who cannot afford court fees file a civil suit?

Order XXXIII of the Code of Civil Procedure allows a person without sufficient means to apply for permission to sue as an indigent person. The court examines the application and the applicant's means. The calculator does not decide eligibility or automatically reduce the result.

Does Tamil Nadu legal aid automatically waive court fees?

No. Eligibility for free legal services and permission to proceed without paying court fees upfront are separate questions. TNSLSA assesses legal-aid eligibility, while the relevant court decides an indigent-person application under the Code of Civil Procedure.
